IDC Couples Terms & Conditions

Thank you for participating in the IDC Couples program. International Diamond Center ("IDC," "we," "us," or "our") loves celebrating the special moments, stories, and milestones of our customers.

By submitting photographs, videos, testimonials, stories, social media handles, or other content ("Content") through the IDC Couples program, you agree to the following Terms & Conditions.

1. Permission to Use Submitted Content

By submitting Content to IDC, you grant IDC and its affiliated companies a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, enhance, modify, crop, publish, display, distribute, create derivative works from, and otherwise utilize the Content in any media now known or later developed.

This includes, but is not limited to:

  • Websites and landing pages
  • Social media platforms
  • Email marketing campaigns
  • Print advertising
  • Magazine advertisements
  • Newspaper advertisements
  • Direct mail campaigns
  • Showroom displays
  • Billboards and outdoor advertising
  • Television and digital advertising
  • Promotional and marketing materials
  • Educational and informational materials
  • Internal business communications

2. Commercial Advertising Acknowledgment

You acknowledge and agree that IDC may use submitted Content for commercial advertising, marketing, promotional, branding, publicity, and related business purposes.

By submitting Content, you expressly authorize IDC to use the Content in paid and unpaid promotional campaigns without additional notice or approval.

3. Ownership and Authority

By submitting Content, you represent and warrant that:

  • You are at least 18 years of age.
  • You are the owner of the Content, or you have the legal authority and necessary permissions to submit the Content to IDC.
  • You have obtained all rights, permissions, licenses, and approvals necessary to grant IDC the rights described in these Terms & Conditions.
  • The submission and use of the Content will not violate any agreement, contract, copyright, trademark, privacy right, publicity right, or other third-party right.

4. Photographer and Copyright Permissions

If any submitted Content was created by a professional photographer, videographer, content creator, or other copyright owner, you represent and warrant that you have obtained all necessary permissions, licenses, releases, and authorizations required to permit IDC's commercial and promotional use of that Content.

By submitting Content, you specifically represent and warrant that:

  • Any photographer or copyright holder has authorized the submission and use of the Content by IDC.
  • Any contractual restrictions that would prohibit IDC's use of the Content have been satisfied or waived.
  • You have the right to authorize IDC's use of the Content as described in these Terms & Conditions.

IDC reserves the right to request proof of ownership, authorization, licensing, or permission from any submitter prior to using submitted Content.

5. Consent of Individuals Depicted

You represent and warrant that all individuals appearing in the submitted Content have consented to the use of their likeness, image, name, and story as contemplated by these Terms & Conditions.

If minors appear in submitted Content, you represent that you are the parent or legal guardian of such minor or otherwise possess legal authority to provide the necessary consent.

6. No Extra Compensation

Except for any promotional incentive specifically offered by IDC, including but not limited to gift cards, contests, sweepstakes, or other promotional programs, you agree that you are not entitled to royalties, licensing fees, residuals, compensation, or any other payment arising from IDC's use of the Content.

You waive any right to inspect, approve, or receive compensation for any advertising, marketing, promotional, or other materials incorporating the Content.

7. Release of Claims

You release and forever discharge IDC, its affiliates, officers, directors, employees, agents, representatives, successors, and assigns from any claims, demands, liabilities, causes of action, damages, or expenses arising out of or related to IDC's authorized use of the Content.

8. Indemnification

You agree to defend, indemnify, and hold harmless IDC, its affiliates, officers, directors, employees, agents, representatives, successors, and assigns from and against any claims, demands, damages, losses, liabilities, costs, expenses, and reasonable attorneys' fees arising from:

  • Your breach of these Terms & Conditions;
  • Your submission of Content without proper authorization;
  • Any allegation that submitted Content infringes the intellectual property, privacy, publicity, contractual, or other rights of a third party;
  • Any false or inaccurate representation made by you in connection with the submission of Content.

9. Removal of Content

IDC reserves the right, but not the obligation, to remove, discontinue use of, or decline to publish any submitted Content at any time and for any reason.

10. Privacy

Personal information submitted through the IDC Couples program is subject to IDC's Privacy Policy.

Please review our Privacy Policy for details regarding how personal information is collected, used, stored, and protected.

11. Entire Agreement

These Terms & Conditions govern your participation in the IDC Couples program and supplement any other policies, disclosures, or agreements provided by IDC.

By submitting Content to IDC, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
